Licensing Terms

Introduction

This End User License Agreements (EULA) is an agreement between En Passant Foundry and their licensees. License types, License coverage, Restricted usage, Prohibited usage.

Copyright

Fonts are protected under copyright law. En Passant Foundry is the exclusive owner of all intellectual property rights, including rights under copyright law. Including but not limited to; redistributing, reselling, giving out for free, sharing, or any commercial or non-commercial activities not allowed by this agreement. Licensee will be held legally responsible for any infringements on the En Passant Foundry’s rights caused by failure to abide by the terms of this EULA.

Modifications

The licensee may not modify the font(s) files, or create derivative font(s) based on the font(s). Contact us at info@enpassantfoundry.com if you want to modify our fonts.

Licensee Coverage

We use company size as a metric for pricing and limiting our licenses. We offer desktop, web, app, social media licenses through our website.

For server licenses and licenses outside of the scope of our retail licenses contact us at licensing@enpassantfoundry.com

The License Holder

When you make something with our fonts for a client, that client is required to own a license. They will have to be a “License Holder”.

Buying a font on behalf of a client or third party

When buying a font on behalf of the client, you, the “Intermediate Designer” have to register the License Holder with us, in this case your client. You, the intermediate designer, will be granted subcontractor license coverage giving you permission to make things for the License Holder using the fonts licensed under their license.

Working with subcontractors

Additional subcontractors require additional coverage.

Desktop License

Font format: OTF, TTF font files

Enables font installing on computers for the use of DTP software. License includes logo usage if company size < 50 ppl. license includes social media usage if company < 3 ppl. OTF files can not be used to render live text online, you’ll need to purchase a web license.

Web License

Font format: WOFF, WOFF2 font files

Allows a licensee to self host the font(s) on a web server to display live text on a website on a website, referencing it with @fontface method. Limited to 1 web domain per license.

App License

Font format: OTF font files

With an app license you can embed the fonts into one app (a mobile app, desktop app, web app or game). An app is limited to 1 app per license.

Broadcast License

Font format: OTF font files

Allows a licensee to make materials for a film using the licensed font.

Advertising License

Font format: OTF font files

Allows a licensee to make materials for paid advertising using the licensed font.

Restrictions

Things you can’t do:

  • • Distribute font files without licensing permission
  • • Modify our fonts without licensing permission
  • • Embed fonts in a way that end users can access them
  • • Give the fonts to anyone without a copy of this contract
  • • Put the fonts on public servers
  • • Put the fonts in public repositories
